1. Overview and Legal Entity

Throughout the site, the terms โ€œweโ€, โ€œusโ€ and โ€œourโ€ refer to LUCKY FECKERS COMPETITIONS PTY LTD. We offer this website, including all information, tools, physical merchandise, and membership tiers available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site, purchasing merchandise, or subscribing to a membership tier, you engage in our โ€œServiceโ€ and agree to be bound by the following terms and conditions (โ€œTerms of Serviceโ€, โ€œTermsโ€), including those additional terms and conditions and policies referenced herein or available by hyperlink.
2. Nature of the Business (Rewards Club & Merchandise)
Lucky Feckers operates as an exclusive social, apparel, and rewards club. We sell premium physical merchandise (including but not limited to club apparel, jerseys, pens, andย  ย holders), along with various digital membership access packages.
From time to time, as a loyalty benefit to our active club members, we host promotional trade promotion giveaways ("Loyalty Rewards Draws"). Purchasing a club membership package or designated apparel item may grant the member complimentary promotional entry allocations into these active draws.
Important Underwriting Note: You are explicitly purchasing a commercial membership package or club merchandise. You are not purchasing lottery tickets, raffle entries, or gambling products. Complimentary access to our trade promotions is a standard customer loyalty benefit and is entirely secondary to your membership or product acquisition.
3. Eligibility
To create an account, purchase a membership tier, or access our services, you must be a resident of Australia and at least 18 years of age. By agreeing to these Terms of Service, you represent that you are of legal age in your state or territory of residence to enter into a binding financial agreement.
4. Membership Tiers, Billing, and Subscription Management
  • Membership Plans: We offer both one-off membership/merchandise packages and recurring periodic membership subscriptions.
  • Billing: For subscription plans, your payment method will be automatically billed at the frequency explicitly stated at checkout (e.g., monthly). All payments are handled via secure third-party payment gateways.
  • Account Responsibility: You are responsible for ensuring that your account details, contact information, and billing details are completely up to date.
  • Cancellation: You retain complete control over your subscription and may cancel at any time directly through the Lucky Feckers Member Portal or by emailing luckyfeckers@gmail.com. To avoid automated billing for the subsequent cycle, cancellations must be processed at least 48 hours before your next scheduled payment date.
5. Promotional Loyalty Draws (Trade Promotions)
All giveaways, promotional draws, and rewards distribution held by Lucky Feckers are classified strictly as Trade Promotion Lotteries under Australian law.
  • These promotions are conducted solely to promote the sale of Lucky Feckers goods, services, and club memberships.
  • Where required by state legislation, draws are fully backed by valid regulatory trade promotion permits.
  • Terms, specific conditions, close dates, permit details, and prize breakdown structures for individual draws are updated transparently on our dedicated Lucky Feckers Trade Promotion Conditions Page.
6. Strict No-Refund and Chargeback Prevention Policy
  • Final Sale: Because physical goods are shipped out, and digital membership assets and promotional loyalty draw spots are instantly provisioned at the moment of checkout, all purchases are final.
  • Post-Draw Restrictions: Absolutely no refunds will be approved after a promotional loyalty draw has closed or taken place under any circumstances.
  • Chargebacks: Initiating a formal chargeback dispute with your credit card provider or financial institution for a legitimate membership fee or apparel purchase is a direct violation of these Terms. We log user metadata, IP logs, checking-out transaction data, and proof of service delivery, and will submit this information to defend against fraudulent or bad-faith payment disputes.
7. Limitation of Liability and Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you have under the Australian Consumer Law (Competition and Consumer Act 2010). For physical goods that fail to meet statutory criteria (e.g., faulty apparel), you are entitled to a replacement or refund.
To the maximum extent permitted by law, LUCKY FECKERS COMPETITIONS PTY LTD will not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the website or participation in club membership perks.
8. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Western Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Western Australia and the Federal Courts of Australia sitting in Perth.
9. Changes to Terms of Service
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
